Questions re a Dr. induced vaso vagal response

Over a month ago, I had a Dr. induced vaso vagal response. This was due to their neglence and to the Dr. not properly monitoring his interns. They hit my vegas nerve in two places, the ear and near the thyroid. A different Dr. explained what they did to me. My question is this. Since then, my ear has been hurting worse and worse. I can't sleep on that side anymore. I am getting headaches and pain in my neck from the side of the ear that they hurt. My dr. said that this is all related. The dr who hurt me is trying to get out of any responsibility. So, what recourse do I have with the Dr. who hurt me? What long-term problems should I be expecting from all that happened?
